Summary
The law of treaties is one of the branches of international law whose roots go back furthest in time. With the emergence of political communities came the need for them to deal with each other, to settle questions in dispute without having to go to war, to arrange the consequences of success or failure after a war had been fought, to strike alliances, organise matters of trade, settle territorial limits to their power, and so on. For such matters they needed from early times some accepted rules covering two matters, the sending of envoys and the making of agreements. Both have remained central to the conduct of what we now call international relations.
Over centuries, the rules and practices governing those agreements have evolved into the modern law of treaties. The evolutionary process is a continuing one. A book on the law of treaties written at the end of the nineteenth century is recognisably about the same subject as its equivalent written today. Yet, while the general body of the law remains broadly stable, times change and bring with them changes in the law. International organisations have emerged as significant actors in the treaty-making process; multilateral treaties are nowadays concluded more frequently, and have more parties, than used to be the case – a reflection of the enormous increase in the number of states during the course of the present century – and there have been great technological changes, especially in communications, which have noticeably affected the process by which treaties are negotiated and concluded.

Summary
The ‘nationality of claims’ rule is, on the face of it, beguilingly clear and simple. It requires that a state instituting international legal proceedings against another state in respect of damage which that other state has caused to a private person must show that that person possesses its nationality.
The rule is well established in customary international law, and is of pivotal importance for the whole process whereby states may be held responsible for acts causing damage to private persons. Its underlying rationale was set out by the PCIJ in the Panevezys–Saldutiskis Railway case, where it said that ‘in taking up the case of one of its nationals … a State is in reality asserting its own right … This right is necessarily limited to intervention on behalf of its own nationals because, in the absence of a special agreement, it is the bond of nationality between the State and the individual which alone confers upon the State the right of diplomatic protection.’
The rule underlies every case in which a state institutes proceedings in the ICJ in respect of damage done to a private person at the hands of the respondent state. In most cases its requirements cause no real difficulty. In three, however, its application has been particularly significant – the Advisory Opinion on Reparations for Injuries Suffered in the Service of the United Nations, and the judgments in the Nottebohm case, and the case concerning the Barcelona Traction, Light and Power Company Limited.

As students at the Durham medical school in Newcastle during the early thirties, we were taught that illness could be due to certain factors and these were listed. The malady could be caused by infection, acute or chronic, trauma, neoplasia. … there were many possibilities but at the very end was a sort of garbage bin for all the diseases which did not fit neatly into the organic syndromes; these were called hysteria or psychoneurosis. These functional cases were diagnosed in a purely negative way, by a process of exclusion. No attempt was made to explain possible reasons for these troubles and there were no suggestions as to how to treat them. We were led to believe that such people were no more than time-wasters, suffering from unworthy maladies. If neurosis in all its forms gave rise to disdain, psychosis produced overt panic, as exemplified in the following case history. A young woman of 20 was admitted to a medical ward in the late stages of pregnancy because she was suffering from severe Sydenham's chorea. She was so bad, she was constantly in danger of falling out of bed and she was quite unable to speak coherently. It must have been because of this she was deemed mad, and a respectable medical ward was certainly no place for a lunatic. Fear in both the medical and nursing staff had completely obliterated all feelings of compassion. She was certified and transferred to the asylum where she died the next day. It was well known that chorea gravis carried with it a bad prognosis and, after all, there were side wards. The poor lass should have been allowed to die in dignity in one of them.
